According to the Tourism Act, the following enterprises are travel enterprises:
- Tour operators are enterprises that prepare package tours and sell them themselves or through another travel enterprise
- Travel agents are enterprises who resell package tours prepared by the tour operator on behalf of the tour operator
- Enterprises offering related travel arrangement services are enterprises that offer linked travel services (new from 1st July 2018).
When operating as a travel enterprise, it is required to submit a notice of economic activity of a travel enterprise to the Register of Economic Activities, and the enterprise must have a security in accordance with the requirements set forth in the Tourism Act. A travel agent who mediates only the trips of another travel enterprise established in Estonia or a country of the European Economic Area does not have to submit a notice and have a security.
A security that at any time guarantees all claims against the travel enterprise arising from the package travel contract of the passengers or the linked travel arrangement contract, including all sums received as advance payments from the passengers and unredeemed package travel gift cards, is required. At the same time, the security must cover the costs of the passengers' return to the starting point of the trip and, if necessary, intermediate accommodation if the travel enterprise has become insolvent and if the package travel or linked travel arrangement includes transportation.
The activities of travel enterprises are supervised by the Consumer Protection and Technical Regulatory Authority.
